H-1B visas are work visas that allow foreign nationals to temporarily work in the United States for a U.S. employer. A U.S. employer may petition a foreign national under the H-1B classification which specifically applies to individuals in a “specialty occupation." A specialty occupation has three requirements. First, an individual must have a bachelor’s degree or higher degree or its equivalent for the particular position. Second, the degree must be common in the industry among similar organizations. Third, the employer must normally require a degree or equivalent; or the nature of the specific duties is so specialized and complex that knowledge required to perform the duties is usually associated with attainment of the degree.
Individuals with H-1B visas are allowed to work in the United States for up to six years, but visas are granted in three-year increments. In some cases, the H-1B visas may be extended for more than six years. If the individual is in the United States, a change of status to an H-1B is filed in the United States. If the individual is outside the United States, upon approval of the petition, the individual must apply for an H-1B visa at the U.S. consulate. There are only 65,000 H-1B visas issued per year.
The beginning of the fiscal year for 2010 is October 1, 2009. Employers may begin filing their petitions six months prior to the start date of employment but the individuals cannot start their jobs until October 1.
It is vital for those individuals wishing to work in the United States to begin preparing their H-1B paperwork before the cap is reached. As of August 7, 2009, approximately 44,900 H-1B cap-subject petitions had been received by U.S. Citizenship and Immigration Services (USCIS) and counted towards the cap. Please call us at 214-999-9999 if you would like to begin the H-1B process. The H-1B cap-subject count is available at the USCIS Web site (http://www.uscis.gov).

Hi,
I am wondering if I can sent both my and mywifes EAD applications in one envelope to USCIS or do I have to send them separately. I am not asking to save money on postal costs , as everyone knows we all spent 1000's of dollars in this GC process. I am only asking so that our(my and mywife) applications are processed together?

You can send both in one envelope But write separate checks for each one. (Remember attrorney send entire set of I-485+I765+I131 for each family member in same envelope).

Hi,
I applied for my first EAD in May 2007 and had FP done in June 2007. I am now applying for my EAD renewal. Will there be another FP for the renewal?
This is really urgent as I am traveling to India in April for a month and I don't want to miss the FP appointment. Please let me know if you have info on this?

Yes, you can use same AP document for multiple entry/stampings, the second time CBP stapled a paper to the original so they can keep stamping and the new paper. Now this additional document had columns and rows set for 12 more stampings, any link to the memo that says only 6 entries per AP?

When you reach NSC or TSC, you talk to an IO. Who really is an IO? Are they first line of customer service at the centers? They then send requests etc to officers handling your cases?

Technically, you can do that. But it's better for you to transer your case to consular processing if you are not planning to be in the US for a couple years.
I forget to mention that it is for my wife. she is my dependent with EAD and AP. i know if she have green card she have to stay 6 months in usa. it that applies to EAD and AP also.

You will get the extension from the CIS here. You will only need to go to Canada if you want the visa stamped on your passport.

There is a change of status form available on USCIS website. It is called I-539:

Go through the instructions of this form. I followed the instructions in this form and sent every document they asked for. My wife also changed her status from F1 to H4. After you send everything, you will get a receipt in 2-3 weeks and approval notice will take ~3 months.

I had filed my I485 directly at TSC , the address which was listed on my I140 Receipt on June 25th as per the advise given by IO when i called the 800#

I have two I -140's approved with one PD from end of 2005 and other end of 2006 both on EB2. I 485 is based based on 2nd one in 2006. So question is can I port 2005 pd to I 485 based on 2006?
Some where I heard that you can only port the PD when your 2nd is application stage and is pending. but here it is applied and already approved. Is it a good case for Porting PD or interfiling?
And by the way what is the difference between porting and interfiling?

Porting and interfiling are pretty much same ...( some use interfiling to use cross changeability ) .
you should be able to use your old PD ...Just ask your attorney to contact USCIS with your old I 140. and New I 140. Lot if times USCIS automatically links your PD's . But again its USCIS?? Just follow up with your attorney , you can take a infopass and show them your documents ( some officers are Info pass know the issue and will help you )

President Obama will send up to 1,200 National Guard troops to the Southwest border and increase spending on law enforcement, yielding to demands from both Republican and Democratic lawmakers there that border security be tightened, administration officials said.

I agree that you should just send the G-325, if that is all they ask for. Just follow the instructions on the RFE regarding how to respond.

Please give us more details , don't mention color of the receipts(one is Visa appointment fees and second Visa issuance fee )
as far I remember , the receipt used to get visa appointment should match with what you you submit at consulate. If you have lost it then u need to get another DD and book/if possible edit the appointment deatils
But if you have lost Visa issuance fees , u don't have to modify ur appointment details but sure you need to get another DD
my wife still needs to go for VISA, HDFC gives 2 receipts.. 1 which we have to submit(yellow), I have that .. .the other 1 that we have to show at the time of interview.. (pink) I have a copy of tht (stamped by HDFC)..
