one way i am thinking of doing is asking for a EVL from the new company with the same kind of job description. 10 years ago, all these laws (to be in the same job description was having some meaning , people used to get GCs in less than a year), but these days it takes anywhere between 5-7 years, and how can uscis expect someone to be in the same description working for 7 years. it just doesnt make sense when you want to be competitive in the market.

Unless you screw up something, they will not deny in Canada. But may in the rarest of cases ask you to go to your country of origin to get the visa.
Having a US degree helps. Just appear confident and brush up your English and accent(do not fake it. Just be normal and greet as you do with American friends. Also do not show off.). The VO really like people who seem to have assimilated into the culture.

I have used the USPS service in the past twice and both the times the documents reached safely....I donot remeber which service I had used though...
anyways, since I was short of time this time I used FedEx , around 58$ upto 0.5 LBs (mine was 0.49 -;) ) it reached chennai in 3 days. ...my parents had thier interview got the visa and are now here....all izz well !!

They probablly will put one or two into it, but I would think most of the conference member will be from other sectors, which could be positive.
Also, PACE act is almost guarenteed to go through; We can spend all the energy to push the immigration bill to get it through the conference and then get killed again either in Senate or House because of the guest worker program.
Don't forget that the House (Anti) Immigration Caucus has 92 members -- be assured that if not Sensenbrenner it will be another equally virulent member. Also, conference committees are nominated by the leader of the house -- nothing to stop them from nominating anyone they want.

Hi all, my first post here. The forum has been truly useful so far and I'm glad to join today. I was one of those just lurking around but now I really need the feedback from D70 experts here since my 6 month old D70 won't work anymore overnight. I just put it back in the shock-proof case and it slept there, next morning it was no longer usable.
It seems like it's resetting constantly by itself. The MENU key shows the menu briefly and disappears, the last picture review button shows the last picture on the flash card briefly and also disappears.
When there's a card in it blinks the green light about once a second. Seems like it's really rebooting every second.
There is no display on the control LCD near the on/off switch. It is blank and does not show any traces of anything, just plain blank.
On the big LCD preview screen it is normally blank but like I said it does briefly display the last picture taken when you press review, but then disappears also at 1 second interval.
When the menu shows briefly after pressing MENU the movement keys do not affect the selection, all keys seem disabled during that brief period of time.
I've changed batteries, lenses, pushed every button and checked the lens socket connectors to see if anything looked strange - everything seems ok here. Tested the same batteries on another D70 and worked perfect just this morning.
It has taken no shocks or beating. It's a brand new D70 (6 months and a few days) and my retailer denies me warranty after 6 months - Murphy's Law applied to warranties says your equipment will break exactly after the warranty voids. I feel like I've been ripped off buying a refurbished piece for the price of a new one...but that's for another discussion.
I've written Nikon a few minutes ago but in the meantime I'd like to know if anyone here knows of a "keylock" switch or something that could disallow me access to the camera. Or could be a stuck reset switch or something like that. The menu shows and the internal mechanism is ok because it can read the last photo and displays readable stuff. The reset on the bottom of the camera does not seem ot reset anything, it just blanks the screen out briefly but then it goes back into an infinite reboot loop.
Help please!

Infopass would not hurt.....so just take Infopass to ease ur mind. Explain to the IO ur exact situation & ask them to confirm if ur 485 is ok. u will have the answer from the horse's mouth/
I would infopass and make sure everything is right. Its good to make sure everytihing is set right, to have peace of mind later, even if it takes to pay some money to an very good attorney (just in case your guys isnt very good)

What troubles me is the "agreed on paper" part. Clearly, your employer has violated H1 terms by not paying you. DOL is bound to take action against your employer for it. However, H1s are not supposed to work in the kind of agreement you seem to have setup. Given that fact, DOL inquiry will probably affect you too. Talk to a lawyer about your options before going to file a complaint against your employer.

You can search for various attorney's (including Rajiv of immigration.com and Murthy of murthy.com) answers for ur specific question either in their websites or thru google. I did some research on this specific thing in the past and also had confirmed with immigraion HR in my company. So I am pretty much sure that you are not counted against the cap. You would need to apply before the visa (F1/opt period) expires so that you dont get to stay in US without any valid visa. so no hurry and dont worry about adv degree cap.

I'm planning to travel to India next month. My passport expires in December 09 and my H1b stamp on the passport expires in July of 2010. Will there be any problem at the POE because of the short valid months left in the passport and H1B visa.

Doesn't the H1 takes effect only if you join them. I dont think just getting approval alone change your status.
Otherwise is there any source for this claim
If the approval notice has new I-94 then new status has taken effect. Infact new I-94 will also have H-1B written as well, if the new status is H-1B.
Person has to file for another change of status if he/she wants to go back to old status.

1) approved RIR labor 2002
2) approved perm labor 2005
3) approved i-140 2006 (PD 2005)
4) ALL of above for company-A. 2006 company-B took over.
My lawyer said i cannot file and have to start again with new labor as merger/acquistion was 'asset only' type.
I want to self-file i-485 giving the company "name change" letter as the only proof along with the rest of regular documents. Company-B employer is in 100% support of my application.
SHOULD I just waste $$$$ money or take a chance ? PLEASE HELP...TIRED OF WAITING FOR LAST 5 years :(
